These Terms of Service ("Terms") are a binding legal agreement between you ("you" or "User") and LambdaWorx LLC, a California limited liability company ("LambdaWorx," "we," "us," or "our"), the provider of TuneView, governing your access to and use of TuneView, including the website at tuneview.io, the TuneView application, and any related services, features, content, and software (collectively, the "Service" or "TuneView").
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE IMPORTANT DISCLAIMERS, A LIMITATION OF LIABILITY, AND A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER (SECTION 14) THAT AFFECT YOUR LEGAL RIGHTS.
By accessing, registering for, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Account Registration
1.1Age. You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.
1.2Account. Some features require you to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorized access.
1.3One Account Per User. You may not maintain multiple accounts, share your account, or transfer your account to any other person without our prior written consent.
2. Nature of the Service — Analysis and Guidance, Not Professional Advice
2.1What TuneView Is. TuneView is a data analysis platform for user-supplied vehicle data, including engine control module ("ECM") data logs, tune files, and related telemetry. Based on your uploaded data and stated goals, the Service may present suggested parameter revisions and step-by-step editing guidance derived from automated analysis and TuneView's calibration knowledge base. All suggestions are starting points for your own evaluation — not instructions, prescriptions, or engineering determinations.
2.2What TuneView Is Not. The Service does not provide automotive, mechanical, engineering, or other professional advice. TuneView never writes to, flashes, modifies, or otherwise alters any ECM, vehicle control unit, or vehicle system. You, and only you, decide whether to apply any change, and you apply it with your own tools, at your own risk. No suggestion presented by the Service is a representation that a change is safe, appropriate, legal, or effective for your particular vehicle, hardware configuration, fuel, environment, or use.
2.3Required Equipment and Competence. Engine calibration assumes — and the Service is designed for users who have — appropriate diagnostic equipment and the mechanical and technical knowledge to evaluate and implement calibration changes safely. By using the Service you represent and warrant that you possess, and know how to use, the diagnostic equipment appropriate to the changes you make (including, for example, wideband oxygen/air-fuel monitoring, knock detection, and datalogging), and that you have the mechanical knowledge required to make the revisions necessary and to recognize unsafe conditions. If you do not have this equipment or knowledge, do not apply any suggested revision — engage a qualified professional instead.
2.4Assumption of Risk — You Are Solely Responsible. Any decision to modify, calibrate, tune, repair, or operate a vehicle based on information or suggestions from the Service is your sole responsibility. You acknowledge and agree that: (a) modifying a vehicle's ECM or related systems can cause catastrophic engine damage, drivetrain damage, fire, personal injury, or death, and you knowingly and voluntarily assume all such risks; (b) suggested revisions are generated from aggregated data and your uploads, may be incorrect or inappropriate for your vehicle, and must never be applied without your own independent verification; (c) before operating any vehicle with a modified calibration, you are responsible for validating the calibration using appropriate diagnostic equipment and controlled conditions (such as a dynamometer or closed course), engaging qualified professionals where needed; and (d) vehicle modifications may void manufacturer warranties and may affect the legality of operating a vehicle on public roads and its insurability.
2.5Emissions and Legal Compliance. Vehicle modifications may violate federal, state, or local emissions, safety, and motor vehicle laws, including but not limited to the U.S. Clean Air Act and California Air Resources Board ("CARB") regulations. Compliance with all applicable laws is solely your responsibility. The Service may not be used to remove, disable, bypass, or defeat any emissions control device or system (see Section 6), and nothing presented by the Service is an endorsement of any modification that is unlawful for your vehicle in your jurisdiction.
2.6No Professional Relationship. Use of the Service, including any TuneView purchase or support engagement, does not create a professional, advisory, fiduciary, or consultative relationship between you and LambdaWorx.
2.7Paying Does Not Change This. Purchasing a TuneView product or support service buys access to analysis and guidance tools — not an outcome. No fee paid to LambdaWorx creates any warranty of performance, drivability, safety, reliability, or emissions compliance, or shifts any responsibility under this Section 2 from you to LambdaWorx.
3. License to Use the Service
3.1Grant. Subject to your compliance with these Terms, LambdaWorx grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal or internal business purposes.
3.2Restrictions. You agree not to: (a) reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service; (b) copy, modify, distribute, sell, lease, or sublicense any part of the Service; (c) use the Service to build a competing product or service; (d) use any automated means (bots, scrapers, crawlers) to access the Service except as expressly permitted by us; (e) interfere with, disrupt, or attempt to gain unauthorized access to the Service or its related systems; (f) remove, alter, or obscure any proprietary notices on the Service; or (g) use the Service in violation of any applicable law or third-party right.
4. Full Tune Purchase, Fees, and Access
4.1Full Tune. Full Tune is a $69 one-time purchase. It covers one vehicle/motor for unlimited analyses and revision rounds, with no expiration. Product details are shown on the pricing page before checkout.
4.2Billing. Purchases are billed once at checkout through our third-party payment processor, Stripe. By providing payment information, you authorize LambdaWorx and Stripe to charge the displayed $69 one-time total, applicable taxes, and no other amount.
4.3No Automatic Renewal. Full Tune does not create a subscription and does not renew automatically. TuneView will not initiate a recurring charge for a Full Tune purchase.
4.4Price Changes. We may change prices for future purchases. A later price change does not reduce the product access already attached to a completed purchase or add a recurring charge.
4.5Refunds. Except where required by applicable law, fees are non-refundable. Failing to use purchased TuneView access or ending a support engagement before achieving a desired outcome does not itself entitle you to a refund. If a purchase is fully refunded or disputed, its unused access and future revision-round entitlement may be revoked; reports already delivered may remain visible as a record of completed work.
4.6Taxes. Fees are exclusive of applicable taxes, which are your responsibility.
4.7Failed or Delayed Payment. A checkout does not grant purchased access until Stripe reports that payment is paid. If payment fails or remains delayed, TuneView may withhold access until Stripe confirms payment; you should not start a second checkout while the first is still processing.
4.8Fraudulent Activity. If we determine, in our reasonable discretion, that your account or a transaction involves fraudulent or unauthorized activity — including use of stolen or unauthorized payment methods, card testing, chargeback abuse, manipulation of checkout, or attempts to obtain unauthorized access — we may immediately suspend or terminate your account, cancel pending access, revoke improperly obtained entitlements, and refuse future service. Fraudulent activity entitles you to no refund, credit, deliverable, or continued access of any kind. We may report such activity to our payment processor or law enforcement, and you are responsible for chargeback fees and other costs we incur as a result of that activity.
5. User Content and Data
5.1Your Content. "User Content" means any data, files, logs, tunes, text, or other materials you upload to or submit through the Service.
5.2Ownership. As between you and LambdaWorx, you retain ownership of your User Content.
5.3License to LambdaWorx. You grant LambdaWorx a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display your User Content solely to operate, maintain, secure, and improve the Service for you. We do not sell your User Content.
5.4Aggregated and De-Identified Data. You agree that LambdaWorx may generate aggregated, anonymized, or de-identified data derived from User Content and use it for any lawful purpose, including product improvement, analytics, and research. Such data will not identify you or your vehicle.
5.5Stock Calibration Files. If you upload an unmodified OEM stock calibration file through the Service, you grant LambdaWorx permission to anonymize that file and incorporate the anonymized result into aggregate baseline datasets. Anonymization means: we remove the Vehicle Identification Number (VIN), owner name and contact information, dealer code, and any other direct identifiers before the file enters any aggregate dataset. The resulting anonymized data may be included in TuneView's knowledge base and used to power stock-vs-tuned comparison features. LambdaWorx does not retain or share raw VINs, owner names, dealer codes, or other personal identifiers from uploaded stock calibration files. Your original file is subject to the retention schedule in our Privacy Policy; anonymized aggregate data derived from it does not identify you and is retained as part of the knowledge base.
5.6Your Representations. You represent and warrant that you have all rights necessary to upload your User Content and that your User Content does not infringe any third-party right or violate any law.
5.7Backups. While we take reasonable measures to safeguard data, you are responsible for maintaining your own backups of any User Content important to you. We are not liable for loss of User Content.
6. Acceptable Use
You agree not to use the Service to: (a) upload content that is unlawful, infringing, defamatory, or that violates another's privacy; (b) upload malware, viruses, or other harmful code; (c) harass, threaten, or impersonate any person; (d) attempt to gain unauthorized access to any account, system, or data; (e) misrepresent the origin or ownership of any data you upload; (f) use the Service for any activity that violates applicable law, including emissions, safety, or motor vehicle laws; or (g) remove, disable, bypass, or defeat — or seek guidance for removing, disabling, bypassing, or defeating — any emissions control device or system (including catalytic converters, oxygen sensors, EGR, EVAP, diesel particulate filters, or related diagnostic monitors) in violation of the U.S. Clean Air Act, CARB regulations, or any other applicable emissions law.
We may suspend or terminate accounts that violate this Section without notice.
7. Intellectual Property
7.1Our IP. The Service, including all software, code, interfaces, designs, logos, trademarks (including "TuneView" and "LambdaWorx"), and content provided by us (excluding User Content), is owned by LambdaWorx or its licensors and is protected by intellectual property laws. All rights not expressly granted are reserved.
7.2Feedback. If you submit suggestions, ideas, or feedback to us, you grant LambdaWorx a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without obligation to you.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and disclose information about you. By using the Service, you consent to our data practices as described in the Privacy Policy.
9. Third-Party Services
The Service may integrate with or link to third-party services (including Stripe for payments). LambdaWorx is not responsible for third-party services, and your use of them is governed by their own terms.
10. Disclaimer of Warranties
10.1AS IS. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, LAMBDAWORX DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
10.2No Warranty of Accuracy. We do not warrant that the Service, or any information, analysis, or output displayed by the Service — including any suggested parameter revision or step-by-step editing guidance — is accurate, complete, reliable, current, error-free, or suitable for any particular vehicle, application, or purpose. Any reliance on the Service is at your own risk.
10.3No Warranty of Availability. We do not warrant that the Service will be uninterrupted, secure, or free of viruses or other harmful components.
10.4No Vehicle-Related Warranties. We make no warranty that use of the Service or any information derived from it will produce any particular result, including without limitation performance gains, reliability, fuel economy, emissions compliance, or vehicle safety. LambdaWorx is not responsible for any damage to vehicles, engines, drivetrains, electronics, or other property, or for any personal injury, arising from actions taken based on information you derive from the Service — including damage resulting from applying, or attempting to apply, any suggested parameter revision or editing guidance presented by the Service.
11. Limitation of Liability
11.1EXCLUSION OF DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL LAMBDAWORX OR ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF LAMBDAWORX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.2LIABILITY CAP. LAMBDAWORX'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO LAMBDAWORX IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
11.3Basis of the Bargain. You acknowledge that these limitations, together with your assumption of risk under Section 2.4, are an essential basis of the bargain between you and LambdaWorx, that the fees charged for the Service reflect this allocation of risk, and that we would not provide the Service without them.
11.4California Civil Code § 1542 Waiver. With respect to any release of claims under these Terms, you expressly waive the protections of California Civil Code § 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
11.5Some Jurisdictions. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless LambdaWorx and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e) any action you take or omit to take with respect to any vehicle, ECM, or related system based on information derived from the Service; or (f) any claim, investigation, penalty, or enforcement action by any government or regulatory authority (including the EPA or CARB) arising from your modification of any vehicle or emissions control system.
13. Termination
13.1By You. You may stop using the Service at any time. Stopping use does not itself reverse a completed one-time purchase or create a refund; Section 4 governs purchases and refunds.
13.2By Us. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if continued operation of your account would expose LambdaWorx to legal or operational risk.
13.3Effect. Upon termination, your right to use the Service ends. Sections that by their nature should survive (including Sections 2, 5.4, 7, 10, 11, 12, 14, and 15) will survive.
14. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH LAMBDAWORX AND LIMITS HOW YOU CAN SEEK RELIEF.
14.1Agreement to Arbitrate. You and LambdaWorx agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court if it qualifies.
14.2Arbitration Rules. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures, before a single arbitrator, in Orange County, California, or by videoconference. The arbitrator's award is final and may be entered as a judgment in any court of competent jurisdiction.
14.3Class Action Waiver. YOU AND LAMBDAWORX EACH AGREE THAT DISPUTES MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
14.430-Day Opt-Out. You may opt out of this Section 14 by emailing [email protected] within 30 days of first accepting these Terms, including your name, account email, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
14.5Exceptions. Nothing in this Section prevents either party from seeking injunctive or equitable relief in court to protect intellectual property rights.
15. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 14, any action that is not subject to arbitration must be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 15 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
17. Miscellaneous
17.1Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and LambdaWorx regarding the Service.
17.2Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
17.3No Waiver. Our failure to enforce any provision is not a waiver of that provision.
17.4Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely.
17.5No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights.
17.6Force Majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
